Insolvency Practitioners
As chartered insolvency practitioners, we work in the trade-off between courts, debtors and creditors to obtain workable solutions: We handle estate contracts, bankruptcy proceedings and reorganizations. We see ourselves not only as court-appointed enforcement bodies but also as business and entrepreneurial partners who find sensible solutions, reduce potential damage and help to make the best in case of a crises.
In more than 60 years of dealing with insolvency law, we made the experience that it is usually worthwhile to use the entire range of legal instruments in cases of crisis. But unfortunately, companies in crisis and their advisors often cannot assess the restructuring potential sufficiently, or they still believe in other solutions when a court-assisted restructuring would have been initiated long ago.

Provisional debt-restructuring moratorium
Art. 293 SchKG: The probate proceedings are initiated by:
a. an application by the debtor accompanied by the following documents: a current balance sheet, income statement and liquidity plan or equivalent documents showing the debtor's current and future assets, earnings or income situation, and a provisional reorganization plan;
b. a petition by a creditor who would be entitled to file a bankruptcy petition;
c. the transfer of the files following Article 173a paragraph 2.

Lucerne administrator
Our profession is a national peculiarity: While everywhere else in Switzerland, the administrator function is performed by lawyers, trustees or otherwise appointed persons, the administrator in Lucerne is a special profession. The custodians are examined by the high court and receive a patent (even if - in the 21st century - there is, of course, freedom of movement). As a result, a separate profession has been formed and maintained in our country, organized in the Luzerner Sachwalterverband (since 1901).
